If you have got an accident at work compensation case, then you may be worried about appearing in court. Some people feel that the court case will be stressful and they do not go ahead with the claim because of it. However, the solicitor will be able to deal with the court case and so there is no need for you to worry about it. They might even be able to organise an out of court settlement.
An out of court settlement s when the other party admits liability. This means that they are prepared to say that they were negligent and therefore the accident was their fault. This tends to only happen when there is a lot of evidence in your favour. The solicitor will suggest that you settle out of court because it saves time and money for everyone.
The other party will then offer you a sum of money. Normally the judge will decide how much you are to be awarded. However, your solicitor will have an idea of how much you would have been likely to get because other cases serve as president. There are some websites which also give you an indication of how much compensation you might get for certain injuries. It is normally a range of amounts because it will depend on how sever things are. It would be wise to check these out, although your solicitor should be able to tell you whether they think it is a fair amount or not.
If you cannot agree between you all on the amount to be paid, then the case will go to court anyway. It can be easier to settle out of court though and so it is worth trying hard to get an agreement this way, if you can.
